EVERY person CHARGED with a CRIME has a CRIMINAL RECORD. This includes convictions and charges later found “not guilty” or “dismissed.” Under Massachusetts law, action must be taken by the defendant to petition the court for the expungement and sealing of criminal records.

EXPUNGING a criminal record is the complete destruction of the record as if it is no longer available.

SEALING a criminal record limits who is eligible to access the records of your CORI, making them not publicly available, but access will be available to public safety and law enforcement agencies.

Once your criminal record is expunged or sealed you may legally state you have "no record."

Certain factors determine your eligibility for expungement and sealing of criminal records including the charges, disposition, time since disposition, and whether the request is in the interest of justice.

HOW TO KNOW WHETHER YOU NEED EXPUNGEMENT OR SEALING SERVICES

CRIMINAL RECORD EXPUNGEMENT

An individual may qualify for time based expungement under M.G.L. c. 276 s. 100E-100U if they meet all of the following:

(1) No more than two criminal records (multiple offenses arising out of the same incident are considered a single offense);
(2) The offense didn't result in death or serious injury;
(3) The offense wasn't committed while armed;
(4) The offense wasn't against an elderly or disabled person; and
(5) The offense isn't a sex offense, an OUI, a firearms violation; a violation of a restraining or harassment prevention order; an assault or assault and battery on a household member, nor a felony violation under M.G.L. c. 265.
If the offense is a misdemeanor, you must have completed all parts of your sentence at least 3 years ago; if the offense is a felony, at least 7 years ago.

A criminal charge may qualify for non-time based expungement under M.G.L. c. 276, s. 100K, if the crime was any of the following:

False use of your identification;
Unauthorized use or theft of your identity;
Offense(s) that are no longer a crime (i.e. possessing small amounts of marijuana);
Errors by law enforcement;
Errors by civilian or expert witness(es);
Errors by court employees; or
Fraud perpetrated upon the court.

CRIMINAL RECORD SEALING

An individual may be eligible for conviction sealing under M.G.L. c. 276, s. 100A, if the conviction fell under any of the following circumstances:

Misdemeanor - 3 years after you were found guilty or after any jail or prison time, whichever date is later;
Felony - 7 years after you were found guilty or after any jail or prison time, whichever date is later; or
Resisting arrest.

An individual may be eligible for non-conviction sealing for any of the following case results:

Not guilty finding by a court or jury;
Failure to indict by a grand jury;
No probable cause finding by a court;
Dismissal without probation entered by a court; or
Nolle prosequi entered (entry on the record of no further prosecution by the prosecutor).
