EVERY person CHARGED with a CRIME has a CRIMINAL RECORD. This includes convictions and charges later found “not guilty” or “dismissed.” Under Massachusetts law, action must be taken by the defendant to petition the court for the expungement and sealing of criminal records.
EXPUNGING a criminal record is the complete destruction of the record as if it is no longer available.
SEALING a criminal record limits who is eligible to access the records of your CORI, making them not publicly available, but access will be available to public safety and law enforcement agencies.
Once your criminal record is expunged or sealed you may legally state you have "no record."
Certain factors determine your eligibility for expungement and sealing of criminal records including the charges, disposition, time since disposition, and whether the request is in the interest of justice.
